1. Introduction and Acceptance

These Terms of Service (‘Terms’) constitute a legally binding agreement between you (‘Customer’, ‘you’, or ‘your’) and Vitall Check Ltd (‘Vitall Check’, ‘we’, ‘us’, or ‘our’), a company registered in England and Wales, operating the website https://vitallcheck.co.uk (the ‘Website’).

By accessing or using our Website, placing an order, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Refund Policy. If you do not agree to these Terms, you must not use our Website or services.

2. Definitions

"Services" means the provision of at-home blood testing kits, laboratory analysis, and associated health insight reports provided by Vitall Check.

"Products" means the blood testing kits, collection materials, and any associated goods sold through the Website.

"Insight Report" means the personalised health report generated from your laboratory results, including data interpretation and actionable recommendations.

"Partner Laboratory" or "Lab Partner" means the UKAS-accredited laboratory facilities with which Vitall Check has contractual arrangements to process and analyse blood samples.

"Sample" means the blood specimen collected by the Customer using our testing kit for laboratory analysis.

3. Eligibility and Account Registration

3.1 Age Requirement

You must be at least 18 years of age to purchase and use our Services. By placing an order, you represent and warrant that you are at least 18 years old.

3.2 Account Creation

To access certain features of our Services, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorised access or security breach

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms or engaged in fraudulent, abusive, or illegal activity.

You may access and use the Website only for lawful purposes and in accordance with these Terms.

4.1 Blood Testing Kits

Vitall Check provides clinical-grade at-home blood testing kits designed for self-collection of capillary blood samples. Our Services include:

  • A comprehensive range of specialist test panels covering metabolic health, hormonal health, organ function, immunity, and nutritional status
  • Easy-to-use collection kits with detailed instructions
  • Prepaid return packaging for sample submission
  • Laboratory analysis by UKAS-accredited facilities meeting NHS-grade standards
  • Results are typically delivered within 48 hours of sample receipt by the laboratory
  • Personalised Insight Reports with data interpretation and health action plans

4.2 Laboratory Partnership

Vitall Check acts as an intermediary between Customers and our Partner Laboratories. While we facilitate the testing process and provide Insight Reports, the actual laboratory analysis is performed by independent, accredited third-party laboratories. We maintain quality control standards and ensure all Partner Laboratories hold appropriate UKAS accreditation.

4.3 Not Medical Services

IMPORTANT: Vitall Check does not provide medical services, medical advice, diagnosis, or treatment. Our Services are designed for:

  • Health monitoring and wellness optimisation
  • Proactive health management
  • Educational purposes and personal health awareness
  • Supporting informed discussions with qualified healthcare professionals

Our Insight Reports provide general health information and suggestions based on your results, but do not constitute medical advice. You should always consult with a qualified healthcare professional before making any medical decisions or changes to your health regimen based on your results.

5.1 Ordering and Payment

5.1.1 Product Orders

When you place an order through our Website, you are making an offer to purchase the selected Products subject to these Terms. All orders are subject to acceptance by Vitall Check. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Product unavailability
  • Pricing or product description errors
  • Suspected fraudulent transactions
  • Failure to meet eligibility requirements

5.1.2 When the Contract Is Formed

A contract for the purchase of the Products and Services is formed when our Partner Laboratory accepts your Sample for analysis.

5.1.3 Pricing

All prices displayed on the Website are in Pounds Sterling (GBP) and include applicable VAT unless otherwise stated. We reserve the right to change prices at any time, but price changes will not affect orders already confirmed.

5.1.4 Payment

Payment must be made at the time of ordering using one of our approved payment methods. By providing payment information, you represent and warrant that:

  • You are authorised to use the payment method provided
  • The payment information you provide is accurate and current
  • You will pay all charges incurred by you at the prices in effect when such charges are incurred

5.1.5 Payment Processing

We use third-party payment processors (including Shopify Payments) to handle transactions. Your payment information is processed in accordance with our Privacy Policy and the privacy policies of our payment processors.

6. Delivery and Shipping

6.1 Delivery Terms

  • Standard delivery is via Royal Mail or equivalent courier services
  • Free delivery is available on orders over £100
  • Delivery times are estimates and not guaranteed
  • We are not liable for delays caused by third-party carriers or events beyond our reasonable control

6.2 Delivery Address

You are responsible for providing an accurate delivery address. We are not responsible for failed deliveries due to incorrect address information provided by you.

6.3 Risk of Loss

Risk of loss and title for Products pass to you upon delivery to the carrier.

7. Sample Collection and Submission

7.1 Your Responsibilities

You are responsible for:

  • Following all instructions provided with your testing kit
  • Collecting and handling your Sample in accordance with the provided guidelines
  • Ensuring your Sample is returned within the specified timeframe
  • Providing accurate personal and health information required for testing

7.2 Sample Quality

The quality and validity of your results depend on proper sample collection. We cannot guarantee accurate results if:

  • The Sample is collected or stored improperly
  • The Sample is contaminated or degraded
  • Instructions are not followed correctly
  • The Sample is not returned within the specified timeframe

7.3 Failed Samples

If your Sample is rejected by the laboratory due to insufficient quantity, contamination, or other quality issues resulting from improper collection:

  • Your first replacement kit will be provided free of charge
  • Any subsequent replacement kits will be offered for £40 plus postage
  • We will contact you to arrange replacement kit delivery and payment (where applicable)
  • Original test fees are non-refundable for failed samples due to user error

7.4 Sample Viability

If a Sample is not viable for analysis for reasons outside our control (for example, postal delays, transit conditions, or user error), our replacement policy set out in clause 7.3 applies.

8. Results and Insight Reports

8.1 Result Delivery

Laboratory results and Insight Reports will be made available to you through:

  • Your secure online account on our Website
  • Email notification when results are ready

8.2 Result Timeframe

We aim to deliver results within 48 hours, starting from the moment the laboratory receives your Sample. However, processing times may vary depending on:

  • Laboratory workload
  • Sample quality issues requiring retesting
  • Technical or logistical delays
  • Public holidays or weekends

8.3 Accuracy and Limitations

While our Partner Laboratories use industry-standard testing methodologies and maintain high accuracy standards, laboratory testing has inherent limitations. Results may be affected by:

  • Pre-analytical factors (diet, hydration, medication, time of day)
  • Biological variability
  • Laboratory methodology variations
  • Sample quality

8.4 Data Interpretation

Insight Reports and any Personalised Health Action Plans are provided for informational and educational purposes only and are NOT a substitute for GP or other clinician diagnosis, clinical treatment, or professional medical advice. Always consult a qualified healthcare professional (including your GP) for diagnosis, treatment, and any medical decisions.

9. Refunds, Returns, and Cancellations

9.1 General Refund Policy

Due to the nature of our Products as medical diagnostic goods and for hygiene and safety reasons, we cannot accept returns or provide refunds once a testing kit has been dispatched, except as required by law or as specified in our Refund Policy.

9.2 Cancellations

You may cancel your order before the testing kit is dispatched for a full refund. Once dispatched, cancellations are subject to our Refund Policy.

9.3 Defective Products

If you receive a defective or damaged testing kit, please contact us within 7 days of receipt. We will arrange for a replacement at no additional cost.

10. Intellectual Property Rights

10.1 Ownership

All content on the Website, including but not limited to text, graphics, logos, images, software, data compilations, and the Insight Report format and methodology, is the property of Vitall Check or its licensors and is protected by United Kingdom and international intellectual property laws.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Access and use the Website for personal, non-commercial purposes
  • View and print your own Insight Reports for personal use
  • Use our Services in accordance with these Terms

10.3 Restrictions

You may not:

  • Reproduce, distribute, modify, or create derivative works from our content without written permission
  • Use our content for commercial purposes
  • Reverse engineer or attempt to extract source code from our software or systems
  • Remove or alter any copyright, trademark, or other proprietary notices
  • Frame or mirror any part of the Website without our express written consent

10.4 Your Content

If you provide feedback, suggestions, or testimonials ("User Content"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and distribute such content for any purpose.

  • Partner Laboratories for sample analysis
  • Service providers supporting our operations (e.g., Shopify, payment processors)

12. Disclaimers and Limitations of Liability

12.1 Service Availability

We strive to ensure the Website is available 24/7, but we do not guarantee uninterrupted access. We may suspend or restrict access for maintenance, updates, or circumstances beyond our control.

12.2 Medical Disclaimer (Master)

VITALL CHECK AND ITS PARTNER LABORATORIES DO NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

Our Services (including Insight Reports and any Personalised Health Action Plans) are intended for informational, wellness, and educational purposes only and are NOT a substitute for GP diagnosis, clinical treatment, or professional medical advice.

You should always:

  • Consult with a qualified healthcare professional before making health decisions
  • Seek immediate medical attention for urgent health concerns
  • Discuss your results with your GP or specialist
  • Do not rely solely on our Insight Reports or Personalised Health Action Plans for medical decisions

No doctor–patient relationship. Use of the Website, purchase of Products, or use of any Insight Report does not create a doctor–patient or clinician–patient relationship between you and Vitall Check, and Vitall Check does not provide emergency services.

If you have urgent symptoms. If you think you may have a medical emergency, call 999 (or your local emergency number) immediately.

Results are not definitive. Lab testing has inherent limitations. Results may be affected by timing, sample quality, handling, medications, hydration, lifestyle factors, biological variability, and other factors. Do not make changes to prescription medication or medical treatment based solely on your results.

Third-party laboratories. Our Partner Laboratories perform the laboratory analysis. While we work with UKAS-accredited partners, we do not control the laboratory’s processes and cannot guarantee outcomes in all circumstances.

12.3 No Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR SERVICES AND WEBSITE ARE PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’ WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Services will meet your specific requirements
  • Warranties that the results will be error-free, accurate, or reliable in all circumstances
  • Warranties that the Website will be secure or free from bugs, viruses, or malware

12.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business
  • Loss of data or information
  • Business interruption
  • Personal injury or emotional distress arising from use of our Services
  • Any health consequences or medical conditions (whether detected or undetected by our testing)
  • Any reliance placed on Insight Reports or other outputs from our Services without clinical advice from a qualified healthcare professional

Our total liability to you for any claims arising from or related to these Terms or our Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

12.5 Exceptions

Nothing in these Terms shall exclude or limit our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under applicable law

12.6 Your Statutory Rights

These Terms do not affect your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015.

13. Mobile Messaging Terms of Service (SMS) (Master)

13.1 Scope and application

This section applies if you opt in to receive SMS/text messages from Vitall Check (the ‘Mobile Messaging Service’). By opting in, you agree to these Terms, including this Section 13.

13.2 Opt-in and consent

By providing your mobile number and opting in, you consent to receive recurring SMS messages from or on behalf of Vitall Check, which may include:

  • Order and service messages (e.g., confirmations, shipping updates, account notifications); and/or
  • Marketing and promotional messages (where you have opted in to marketing).

Consent to receive marketing SMS is not a condition of purchase.

13.3 Opt-out and help

You can opt out at any time by replying STOP to any message. After you opt out, you may receive a final confirmation message. For help, reply HELP or contact us using the details in Section 24 (Notices).

13.4 Message frequency

Message frequency varies depending on your interaction with us and your preferences.

13.5 Costs

Message and data rates may apply. Your mobile carrier may charge you for SMS messages and data usage. Vitall Check is not responsible for any charges from your carrier.

13.6 Supported carriers and delivery

Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your mobile network operator and is not guaranteed.

13.7 Eligibility

You must be the account holder or have permission from the account holder for the mobile number you provide. You must notify us if you change or deactivate your number.

13.8 Privacy

We use and protect personal data collected in connection with the Mobile Messaging Service in accordance with our Privacy Policy (including how we use service providers such as messaging platforms). We may use service providers to operate the Mobile Messaging Service, and those providers may process your data on our behalf.

13.9 Telephone Preference Service (TPS)

If you are registered with the Telephone Preference Service (TPS) or Corporate TPS, this may affect certain marketing communications. Where required, we will honour applicable marketing preferences and opt-out requirements. Your SMS opt-in/opt-out choices for the Mobile Messaging Service will be respected regardless of TPS status.

13.10 Changes or termination

We may modify or discontinue the Mobile Messaging Service (in whole or in part) at any time. If we make material changes to this Section 13, we will update these Terms and the “Last Updated” date.

13. Indemnification

You agree to indemnify, defend, and hold harmless Vitall Check, its directors, officers, employees, agents, and Partner Laboratories from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Your misuse of our Services
  • Your violation of any laws or third-party rights
  • Any inaccurate or misleading information you provide
  • Improper sample collection or handling
  • Your reliance on Insight Reports without consulting qualified healthcare professionals

14. Third-Party Services and Links

Our Website may contain links to third-party websites or integrate with third-party services (such as payment processors or social media platforms). We are not responsible for:

  • The content, accuracy, or practices of third-party websites
  • Privacy policies of third-party services
  • Any transactions or interactions you have with third parties

Your use of third-party services is at your own risk and subject to their respective terms and privacy policies.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

  • Update the ‘Last Updated’ date at the top of this page
  • Notify you via email (if you have an account) or through a prominent notice on the Website
  • Provide you with an opportunity to review the updated Terms

Continued use of our Services after changes become effective constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using our Services.

16. Modifications to Services

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of our Services.

17. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, pandemics, or epidemics
  • War, terrorism, civil unrest, or government actions
  • Strikes, labour disputes, or supply chain disruptions
  • Telecommunications or internet failures
  • Failures by Partner Laboratories or third-party service providers

18. Governing Law and Jurisdiction

18.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

18.2 Jurisdiction

Subject to clause 18.3, the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

18.3 Consumer Rights

If you are a consumer residing in Scotland or Northern Ireland, you may also bring proceedings in the courts of your home jurisdiction, and these Terms shall be governed by the consumer protection laws of your home jurisdiction where they provide greater protection.

19. Dispute Resolution

19.1 Informal Resolution

If you have a complaint or dispute, please contact us first at support@vitallcheck.co.uk so we can attempt to resolve the matter informally.

19.2 Alternative Dispute Resolution

If we cannot resolve your complaint informally, you may refer the matter to an Alternative Dispute Resolution (ADR) provider. As an online retailer, we are required to provide a link to the European Commission's Online Dispute Resolution platform, although the UK is no longer part of this scheme following Brexit.

For consumer disputes, you may also contact Citizens Advice or relevant consumer protection organisations.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, it shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

21. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of Vitall Check.

22. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Vitall Check regarding your use of our Services and supersede all prior agreements, understandings, and communications, whether written or oral.

23. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms without restriction, including to any successor or purchaser of our business.

25. Survival

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: Intellectual Property Rights, Disclaimers and Limitations of Liability, Indemnification, Governing Law, and any provisions relating to payment obligations.

26. Language

These Terms are drafted in the English language. In the event of any conflict between the English version and any translation, the English version shall prevail.
